Re: H.R. 4282, Health Freedom Protection Act


Dear Senator Hatch:


On November 9, 2005, H.R. 4282, the Health Freedom Protection Act, was introduced in the House of Representatives. Fifteen members of Congress, Republicans and Democrats, support the bill. It would end FDA censorship of nutrient-disease treatment information vital to the health of the American people. FDA has chosen to prohibit every claim that a nutrient treats a disease, regardless of its validity. FDA is presently suppressing, for example, the claim that omega-3 fatty acids (fish oils) reduce the risk of sudden death heart attacks. That censorship contributes to an estimated 110,000 preventable sudden death heart attacks each year. FDA is suppressing the claim that calcium reduces the risk of bone fractures. Tens of thousands of Americans, particularly the elderly, suffer from preventable bone fractures each year, some of those fractures prove lethal. FDA is suppressing the claim that glucosamine and chondroitin sulfate treat osteoarthritis. Twenty million Americans suffer from the pain and joint stiffness of that disease who could experience relief by relying on these nutrients. FDA is suppressing the claim that saw palmetto treats benign enlarged prostates. Fifty percent of all men aged 50 and older suffer from enlarged prostates who could receive relief from the symptoms if they consumed saw palmetto.

The Health Freedom Protection Act reverses this censorship and opens the market to truth. The bill fulfills the promise of our First Amendment and ends a long legacy of censorship by the FDA. The bill also rests on the Fifth Amendment foundation that no one accused by government of wrong doing should be presumed guilty until proven innocent. That reversal of the due process right that is a bedrock principle in this country is intolerable.

I urge you to introduce H.R. 4282 into the Senate. I want you to sponsor its introduction at the earliest possible moment. Please inform me of your intentions. You have championed health freedom in the past, and I am calling upon you to do so again in the presence of new violations of our constitutional right to receive life saving and health enhancing nutrient-disease information.
